Unfortunately many preexisting conditions may affect the results. Chemical testing provides a more accurate look at a driver’s BAC. Urine, breath, or blood will be analyzed to calculate the BAC. A driver my be subjected to a combination of tests.
Refusing to comply with testing requests will result in a driving suspension of 90 days. Subsequent offenders and drivers under 21 face enhanced suspensions. First offense DUI offenders face a fine of at least $400, public service, and 2 days to 30 days of incarceration. Repeat offenders can face thousands in fines and years in jail.
North Carolina has enacted zero tolerance legislation aimed at punishing drivers under 21 with lower BAC levels. They can be convicted of DUI with a BAC level as low as .02. Resulting in a 3 month license suspension.
